This paper argues that there is continuity in Foucault?s thought, as opposed to the common division of his work into three phases, each marking a distinct field of research - discourse, power, subject. The idea is that there are no radical turns in his work that justify this division; rather, there is a shift of focus: all crucial concepts are present in all periods of his thought and in all of his undoubtedly differently-toned and oriented works. This is shown through (...) examining the characteristics of archaeology and genealogy, their relation, as well as the relation of discursive practices and strategies of power to knowledge. The retrospective and interpretation intend to shed light on the constant interplay between concepts that demonstrate continuity in Foucault?s thought. The viewpoint, based in the integrity of Foucault?s work, offers a better starting point for understanding certain aspects of his theories. (shrink)

The article discusses the reception of Grotius by Catholic lawyers at the university of Prague. It focuses on the Grotius commentary by Nicolaus Ignaz Königsmann, which was meant as a response to the discussion of Central European Catholic lawyers on questions of toleration and permissions in law. I argue that Königsmann agreed with Grotius because his conception could be combined with the Catholic belief in free will and dictamen sanae rationis. He grounded natural law in rational human nature and rejected (...) attempts to derive natural law from the highest principle. (shrink)

Proofs from assumptions are amongst the most fundamental reasoning techniques. Yet the precise nature of assumptions is still an open topic. One of the most prominent conceptions is the placeholder view of assumptions generally associated with natural deduction for intuitionistic propositional logic. It views assumptions essentially as holes in proofs, either to be filled with closed proofs of the corresponding propositions via substitution or withdrawn as a side effect of some rule, thus in effect making them an auxiliary notion subservient (...) to proper propositions. The Curry–Howard correspondence is typically viewed as a formal counterpart of this conception. I will argue against this position and show that even though the Curry–Howard correspondence typically accommodates the placeholder view of assumptions, it is rather a matter of choice, not a necessity, and that another more assumption-friendly view can be adopted. Before examining de Moivre's contributions to the science of mathematics, this article reviews the source materials, consisting of the printed works and the correspondence of de Moivre, and constructs his biography from them. The analytical part examines de Moivre's contributions and achievements in the study of equations, series, and the calculus of probability. De Moivre contributed to the continuing development from Viète to Abel and Galois of the theory of solving equations by means of constructing particular equations, the roots of (...) which can be written in the form $$\sqrt[n]{{a + \sqrt b }} + \sqrt[n]{{a - \sqrt b }}$$. He also discovered the reciprocal equations. In the course of this work de Moivre discovered an expression equivalent to (cos α+i sin α) n =cos n α+i sin n α and, following Cotes, he succeeded in expressing the nth roots of unity in trigonometric form. In the theory of series, de Moivre developed a polynomial theorem encom-passing Newton's binomial theorem and, in particular, a theorem of recurrent series useful in the calculus of probability. The demands of the calculus of probability led de Moivre to an approximation for the binomial coefficients $$\left( {_m^n } \right)$$ for large values of n. The interaction between de Moivre and James Stirling, particularly in regard to the asymptotic series for log (n!), is treated at length. This work supplied the foundation for de Moivre's limit theorem for the binomial distribution. The calculus of probability, which occupied him from 1708 onward, became in time ever more the center of de Moivre's inquiries. Proceeding from contemporary collections of gambling exercises, de Moivre, by introducing an explicit measure of probability for the so-called Laplace experiments, found the beginnings of a theory of probability. De Moivre expanded the classic application of probability calculus to games of chance by addressing himself to the problem of annuities and by adopting Halley's work with its conception of “Probability of life”. De Moivre was the first to publish a mathematically formulated law for the decrements of life derived from mortality tables. (shrink)

Doctrinally, a precedent is a case of the same or higher court that furnishes an authoritative rule for the determination of the case at hand, either because the facts are alike, or, if the facts are different, because the principle that governed the first case is applicable to the different facts. In this article I try to free precedent form the dominant doctrinal view by offering a more intuitive conception: that to be precedent means to be treated as precedent. Put (...) differently, I attempt to see precedent not as descriptive of a previous decision or rule but as the aggregate effect of responses to one or a series of court decisions in the legal community. I illustrate this viewpoint by developing a version of a response-dependent concept that incorporates our intuitive grasp of how precedent works. In the pursuit of this task I rely on the basic philosophical premises of response-dependence theory and on one paradigmatic response-dependent concept—the quality of being funny. (shrink)

This essay focuses on the concept of consciousness in C. S. Peirce’s work, revealing how its ways of being are associated with the three Peircean phenomenological categories. In this article, I intend to reflect on the heuristic power of the mind, namely, its ability to bring about new ideas, which, within Peirce’s logic of inquiry, is called by the well-known term of abduction. The abductive logical step promotes a synthesis of signs that constitutes a logical structure capable of proposing a (...) new mediation or representation of a new phenomenon. I make use of a metaphorical passage from Peirce not only to give the title to this essay, but also to highlight the importance of the first category as a sort of synechistic envelopment of an unprecedented logical structure of signs that composes a new synthesis. Two continua intertwine themselves, namely, those of the first and third categories, to account for what appears as a fact of the world in the theater of secondness. The essay also seeks to bring to light the core realism of Peirce’s philosophy, the genetic aspect of this bottomless lake, through its cosmology, where the generalization of forms and the acquisition of habits of reality are the proper ground of his Objective Idealism. One of the heuristic aspect of the lake metaphor is a sort of invitation to extend the concept of synthesis from the realm of logical structures to that one of arts, which in this essay will remain as a suggestion for a further reflection. In this paper, I argue that the normative framework of liberal democracy is one of the sources of the failure of international climate politics. The liberal framework makes it very likely that at least some democracies will not consent to an international agreement to mitigate greenhouse gas emissions. In this situation, the institution of judicial review might be viewed as crucial to overcome the risk of a tragedy of the commons. However, judicial review cannot serve this purpose in the case (...) of climate change and an institutional change of the kind required cannot be derived from within the normative framework of liberal democracy itself. The main objective of this paper is to sketch unifying conceptual and formal framework for inference that is able to explain various proof techniques without implicitly changing the underlying notion of inference rules. We base this framework upon the so-called two-dimensional, i.e., deduction to deduction, account of inference introduced by Tichý in his seminal work The Foundation’s of Frege’s Logic (1988). Consequently, it will be argued that sequent calculus provides suitable basis for such general concept of inference and therefore should (...) not be seen just as technical tool, but philosophically well-founded system that can rival natural deduction in terms of its “naturalness”. In this paper I will explore the question whether the Trivialization construction of transparent intensional logic (TIL) can be understood in terms of the Execution construction, specifically, in terms of its degenerate case known as the 0-Execution. My answer will be positive and the apparent contrast between the intuitive understanding of Trivialization and 0-Execution will be explained as a matter of distinct yet related informal perspectives, not as a matter of technical or conceptual differences.

In a recent paper by Tranchini (Topoi, 2019), an introduction rule for the paradoxical proposition ρ∗ that can be simultaneously proven and disproven is discussed. This rule is formalized in Martin-Löf’s constructive type theory (CTT) and supplemented with an inferential explanation in the style of Brouwer-Heyting-Kolmogorov semantics. I will, however, argue that the provided formalization is problematic because what is paradoxical about ρ∗ from the viewpoint of CTT is not its provability, but whether it is a proposition at all.

Is there a poetic ground in Peirce's philosophy? While this question may sound interesting, it is somehow odd, as Peirce is well–known as a logician, and it is also known by scholars that he was not an expert in poetry, literature, art, or even theories concerning art in general. This paper hypothesizes that there is a starting point in his philosophy that is poetical in its nature. Moreover, Peirce's system is obviously logical in its form, but also keeps the spirit (...) of the original silent feeling of poetry that seems to have fascinated him. Also, I claim there is a Schellingian heritage in Peirce's philosophy that is partially responsible for that poetic starting point. This idea also has, as a support, the supposition that a realistic view of the world provides a hypothesis of symmetry between the human and natural worlds, which provides the basic form for his ontological theories and for the theoretical harmony among Peirce's doctrines. This quality of Peirce's philosophy is a kind of a Greek beauty that is only evident for those who can view his thought not in fragments but as a complex system that has the potency of not only answering classical philosophical questions, but also of giving rise to a new philosophy which needs to be further developed. Charles S. Peirce Society 2016 Presidential Address Peirce never could finalize a book or publish it and especially no book on the aesthetic basis of pragmaticism. This is not only a historical note, but has a deeper meaning. It arouses in the attentive reader a strong desire to do what Peirce himself did not have the chance to do: to find a way of linking together his hints and clues in such a way that respects the spirit of his work (...) and not just its letter. This practice of apprehending the spirit is successful, I believe, when, on the one hand, we familiarize ourselves with the author’s text and, on the other, perhaps more importantly, when we initiate this apprehension because the text arouses a feeling of... There are significant differences between the neopragmatism as formulated by Rorty, based on James’ and Dewey’s pragmatism, and what Peirce, in order to distinguish his own approach from the last two thinkers, called pragmaticism. I take in this paper the concept of solidarity as a focus, from which those differences will be implied, albeit many other points could be chosen. I highlight that the usual Rorty’s sentence beginning with ‘we pragmatists…’ shall necessarily exclude Peirce. Exemplarily, I could mention the concepts (...) of representation, which for Peirce has nothing to do with mirror, and of truth that, for him, also has no relation at all with fixed essences. Those differences will not only mark a very clear border between the two concepts of pragmatism, but also will question how the idea of community can be supported only by dialogical agreements, without the anchor of common open human experience. Pragmaticism and neopragmatism differ not only regarding their specific range of philosophical problems but, moreover, on what kind of problems they really consider as genuinely philosophical. Starting from the exposition of the fundamental guiding principles of Peirce's philosophy, mainly, its three categories viewed under his Phenomenology and its correlated Ontology, I conjecture about three possible dimensions of Time, considering the function of predicting the future course of events with varying degrees of certainty as the main role of our human rationality. In these three dimensions, the affection of the first of the three Peircean categories occurs with differentiated intensity, this first category precisely the one that includes (...) the way of being of the incidence of Chance, either in the course of a natural Chronos, or in the course of a temporality produced by human actions, or also equally having incidence in the spontaneity of a subjective time, assumed here as Kairós. Inspired by the recent experience of the pandemic that devastated all corners of the planet, this conjecture suggests dimensions of a temporality frayed ontologically in different degrees, leading to a corresponding fraying of our predictive rationality, imposing upon us the condition of being characters who are left to bet on the course of future factuality to the detriment of choices that would be feasible if a history circumscribed by an intense incidence of Chance had not occurred. Mais que simplesmente este imediato sentido fenomenológico da expressão, explorar-se-á, também, o seu significado ético, vale dizer, no que respeita ao âmbito da conduta humana em geral, prisma sob o qual Peirce fundamenta sua crítica à inconsistência de ceticismos sustentados apenas em conjeturas teóricas.: We intend to reflect about (...) the meaning of the expression practical consequences that appears in Peirce's definition of Pragmatism, considering the nearness of his meaning to the Kantian concept of possible experience. This paper intends to expose elements of a Charles S. Peirce's epistemological doctrine, called by him Falibilism. The aim is to show how this doctrine emerge itself from the author's metaphysical theories, like his Evolutionism and categorical structure of Reality, forming a duet with his ontological conception of Chance. In fact, the Falibilism will be considered as the doctrine that is consequence of the Peirce's doble face indeterminism, i.e., at same time ontological and epistemological.Este artigo expõe elementos da doutrina epistemológica (...) de Charles S. Peirce , denominada Falibilismo. Procura-se evidenciar como tal doutrina se desenvolve do interior de teorias metafísicas do autor, a exemplo de seu Evolucionismo e da estrutura categorial da Realidade, formando um dueto com sua concepção ontológica de Acaso. Em verdade, o Falibilismo configurar-se-á como a doutrina que é conseqüência do indeterminismo de dupla face de Peirce, a saber, simultaneamente ontológico e epistemológico. (shrink)

U članku se na temelju teze njemačkoga teoretičara i pionira filozofije tehnike, Ernsta Kappa, o projekciji organa prilikom početnoga stvaranja oruđa, nastoji pokazati kako ta teza ima svoje implikacije još i danas, posebice u pogledu njezine reverzibilnosti. Naime, kada Kapp tvrdi da su sva oruđa nastala tako što je čovjek promatrao svoje organe i njihovu funkcionalnost, a da je među svim organima napose ruka oruđe svih oruđa, onda isto tako valja ustvrditi kako se je danas od projekcije organa prispjelo tome (...) da je čovjek s aspekta tehnike dospio u poziciju da projicira tehnički sofisticirana oruđa za zamjenu ljudskih organa. Sve je prisutnija pojava zamjene ljudskih organa kao pripomoći i u mnogočemu olakšavanja čovjekova života, ali isto tako i svjesne i koordinirane kiborgizacije i robotike s ciljem pospješivanja i unaprjeđenja toga istoga života do razine izazivanja novoga stupnja njegove evolucije. Tako se stvaraju aktualni okviri filozofije tehnike, koja je uvelike započela sa naznačenom Kappovom tezom. (shrink)

We consider the results of adding to a basic modal system T0the axioms G1.CLpp;Pn.CLnpLn+1p; Bn.CpLnMp, where n ≧ 11, in all combinations. The method of Meredith's [7] will be extended to get models of these systems in lower predicate calculus (LPC) with a constant binary relation,U. Most of the results were already obtained in [1]–[6], though systems as in (i) and (ii) below were not investigated, except that S40in (ii) was mentioned in [1]. The principle of common but differentiated responsibilities is a key principle in inter- national climate and environmental governance. This paper explores the normative impli- cations of the differentiation of responsibilities. I explain how responsibility as a four-digit relation can be used to reconstruct the complex networks of responsibilities in climate and environmental governance. I argue that depending on the area, governance level and concrete case of climate and environmental governance, other or differently specified norms become relevant for the differentiation of (...) responsibilities. However, I show that the attribution of responsibility must always consider the actors’ ability for responsibility. I argue that it is not only the fairness of the attribution of responsibilities that matters, but the capacity for responsibility of the relevant agents and their dependence on networks and institutions of responsibility. In this paper I argue for the following conclusions. First, quotas are not normative goals in themselves but only a means to reach non-discriminatory selection procedures. Second, in a democracy quotas are most plausibly used as a means to fill offices in those bodies which have a major impact on how well interests or discourses are translated into policy. Third, quotas for the young can be justified since, due to demographic development, their discourses tend to be marginalized. Fourth, youth quotas (...) cannot be a means to ensure long-term policy-making, but they can enhance legitimacy of long-term impacts from policy decisions taken today. (shrink)

Although I believe that Gardiner and Fragnière are right to claim that geoengineering governance demands participatory structures, I think more caution is needed. First, the public to be considered because it is affected must be differentiated depending on the geoengineering technique at issue and on the severity of its impact. Second, to avoid undermining democratic legitimacy, ethical conditions of legitimacy must be carefully assessed. Even though future generations and nature are very likely to be affected by geoengineering, their representation is (...) not as unproblematic as it might seem at first sight. (shrink)

In this comment I challenge Kerr’s claim that a coherent expression of a ‘liberalism of freedom’ needs an extended first Rawlsian principle of justice incorporating the principle of fair equality of opportunity for two reasons. First, such an extended first principle leads to illiberal consequences by narrowing down the scope of individual responsibility for choice and effort way too much. Second, such an extended first principle misses a main Rawlsian insight, namely that in a theory of justice the principle securing (...) basic liberties and the principle of fair equality of opportunity serve different purposes. Es ist nicht immer so klar, welche Verantwortlichkeiten zum Klimaschutz den einzelnen Bürger:innen legitimerweise auferlegt werden können. Viele Forderungen scheinen leicht zu bewerkstelligen – z. B. die Umstellung der Essensgewohnheiten –, manche überfordern – z. B. die Wahl angemessener Ausnahmen – und wieder andere – z. B. die technische Entfernung von Klimagasen aus der Atmosphäre – sind ohne staatliche Unterstützung nicht zu bewerkstelligen. In diesem Aufsatz entwickeln wir ein Modell zur Unterscheidung zwischen den individuellen Klimaschutzverantwortlichkeiten und den Verantwortlichkeiten des Staates, (...) wenn dieser netto null Emissionen anstrebt. Hierzu unterscheiden wir drei Emissionsniveaus: i.) die aktuell hohen Emissionen innerhalb eines Staates, ii.) die Emissionen, die Bürger:innen aktuell zur gleichberechtigten Teilhabe an einer Gesellschaft benötigen, iii.) die ohne technische Hilfsmittel nicht vermeidbaren Emissionen. Wir argumentieren, dass die einzelnen Bürger:innen ohne staatliche Unterstützung nur für die Reduktion ihrer aktuell hohen Emissionen verantwortlich gemacht werden können. Mit Blick auf alle anderen Emissionen kommt ihnen in erster Linie eine politische Verantwortung zu. (shrink)

Climate change is expected to lead to rising sea levels, higher frequency of natural hazards, extended phases of drought, and many other negative impacts. To minimize these threats, the 21st Conference of the Parties (COP 21) in Paris agreed that the global mean temperature must be kept “well below 2 °C above pre-industrial levels” (United Nations 2015). For this target to be feasible, most climate models assume not only heavy cuts in emissions but also negative emissions via the large-scale capture (...) and storage of carbon dioxide (K. Anderson and Peters 2016). This chapter investigates the considerations of ethics and justice that are relevant to the fair governance of the carbon capture and storage technologies required to produce negative emissions.1 I argue that the governance of these negative emission technologies (NETs) demands the fair distribution of the additional burdens and risks associated with them and that their ethical evaluation requires the appropriate involvement of those most directly affected. The main argument justifying these claims relies on the infeasibility of achieving justice in the governance of NETs. However, the solutions recommended for dealing with this challenge also face some feasibility constraints. I demonstrate how challenges of feasibility shape the directions of moral thinking about this area of climate action. (shrink)

John Searle e Maurizio Ferraris, due tra i più influenti pensatori in ontologia sociale, a dispetto delle radicali differenze tra le loro teorie circa il fondamento del mondo sociale, sono concordi su un punto: gli oggetti sociali sono fortemente dipendenti dai soggetti ma non sono soggettivi. Tuttavia, tale dipendenza non può essere spiegata a fondo attraverso la logica soggetto/oggetto. In questo senso, il presente contributo offre una visione più dinamica, che prende l’avvio dalla specificità del nostro essere-nel-mondo e dalla relazione, (...) complessa e circolare, tra la mente umana e l’ambiente socionaturale. Germany is joining a long list of European democracies that have modified or expressed a willingness to modify their citizenship laws to denationalize first and then prevent the return of or expel those citizens accused of having participated in terrorist activities abroad. The formal labelling of citizenship deprivation as an administrative measure outside the scope of criminal justice has prevented scholars of criminal law from undertaking a thorough scrutiny of its legitimacy. In this paper I seek to fill this gap. (...) Specifically, after demonstrating why deprivation of citizenship is a measure of a criminal nature, I argue against its legitimacy, either as a punishment or as a risk-based measure. Instead I propose that we should understand citizenship deprivation as a paradigmatic response from an illegitimate enemy criminal law. Notwithstanding the foregoing, I claim that states that choose to denationalize terrorists should do it within the framework of a process with the highest (criminal procedural) guarantees. (shrink)

Among the advocates of expressive theories of punishment, there is a strong consensus that monetary fines cannot convey the message of censure that is required to punish serious crimes or crimes against the person. Money is considered an inappropriate symbol to express condemnation. In this article, I argue that this sentiment is correct, although not for the reasons suggested by advocates of expressivism. The monetary day-fine should not be understood as a simple deprivation of money, but as a punishment that (...) reduces the offender’s capacity to consume for a certain period of time. Conceived in this manner, I argue that it is perfectly suitable to convey censure. However, the practical impossibility of ensuring that the person who pays the fine is the same person who has been convicted of the offense seriously undermines the acceptability of the monetary fine as an instrument of censure. Minimizing the risk of the fine’s hard treatment being transferred to third parties is a necessary condition for the monetary fine to be considered a viable alternative to lengthy prison sentences. InnisIvo Assad Ibri Semiotics and Pragmatism: Theoretical Interfaces Springer, 2022, xxvii + 341 pp., incl. indexIn the chapter on 'The Heuristic Power of Agapism in Peirce's Philosophy' in his recent book, Semiotics and Pragmatism: Theoretical Interfaces, Ivo Ibri points out that access to Peirce's work requires something on the part of the reader that is "not readily available (...) in everyone's spirit: a sense of poetry, an aesthetic sensitivity that will, ultimately, become the sharpest and strongest tool to penetrate the deepest meaning of his philosophy" (116). Such a sensitivity is manifested in Ibri's own responsiveness to Peirce's accounts of the permeating qualities of things in a dynamic universe of emerging novel orders and patterns. Ibri's book presents the record, indeed the culmination, of a well-known and wide-ranging long-term engagement with the work of Peirce. It makes available in English translation the contents of the two-volume [End Page 257] collection of his papers in Portuguese published in 2020 and 2021, although a number of them were originally published in English. The title of the book indicates the dynamic triadic nature of Ibri's central Peircean themes: semiotics and pragmatism and their theoretical as well as historical 'interfaces.'Paradoxically, taken alone, the book's main title, 'Semiotics and Pragmatism,' gives no indication that it is principally about Peirce. The reason, I think, is that there is an interwoven duality of, or tension between, the tasks that Ibri has taken upon himself to accomplish in the intellectual journey manifested in the book's contents: (a) Thinking about Peirce, on the one hand, and (b) Thinking with and through Peirce, on the other. This duality of tasks accounts both for the expository and argumentative richness of Peircean themes and the accompanying sense of intellectual engagement and exploration as they are taken up in the various parts of the book: art as an articulated realm of 'nameless things,' the presence of a poetic ground and its links to Schelling in Peirce's philosophy, the nature of abduction and of agapism as heuristic principles, the scope of Peirce's theory of signs and interpretants, the theory of beliefs and the intellectual dangers and poverty of dogmatism, the nature of habits and rational conduct, the centrality of the categories for Peircean pragmatism and objective idealism, the relations between pragmatism, pragmaticism, and neopragmatism, and other technical and subsidiary topics of current social and political importance. The discussion of these themes involves wide-ranging and generous linkages to other parallel discussions that support or expand Ibri's own positions and existential commitments.Ibri frames in a variety of ways the inextricably intertwined strands of semiotics and pragmatism (or pragmaticism) in Peirce's work and argues forcefully in other chapters for Peirce's metaphysical vision of an emergent creative universe marked by the "infinite faces of chance" (122), a vision rooted in Schelling's objective idealism and in scientific discoveries of the 19th century. The organization of the book is thematic and does not develop in linear fashion as a treatise. It can be seen as sequence of engagements or as a series of analytical spirals in which the topics and issues of the book, focused on Peirce's heuristic fertility, are taken up in a kind of dialectical dance of 'retrievals and continuations,' leading inevitably, as Ibri points out, to a high number of repetitions and recapitulations. This is partially due to each chapter in the book, while free standing, functioning as a heuristic device for exploring and arguing for the nature and power of Peirce's interlocking main positions and their shared conceptual underpinnings.In a stimulating chapter on 'The Poetics of Nameless things,' Ibri writes that the Peircean claim of a "correspondence between external and internal worlds" is the "deepest root of pragmatism" (60). Electronic sports and other variants of ‘digital sports’ have increased in popularity all over the world and may even come to challenge hegemonic concepts of sport. More relevant than the apparent opposition between ‘physical’ and ‘non-physical’ is the question what kind of embodiment is manifested within virtual environments. In this paper, we argue that eSports do require the learning and performance of motor skills and that embodiment within a virtual environment may be considered playful or even athletic. The type of (...) skills that might be tested can even be considered fundamental movement skills. Under appropriate educational supervision, with knowledge of the game, eSports can be utilized for the development of specific elements of digital literacy. Although motor skills are a defining characteristic of eSports, we do not argue that eSports should be integrated within PE.
